Terms of Service

By using HealthTrack PRO ("the App"), you agree to these Terms of Service. If you do not agree, do not use the App.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and PROHOSTVPS.COM ("we", "us"). By accessing or using the App, you confirm you are at least 13 years old and agree to these Terms.

2. Description of Service

HealthTrack PRO is a nutrition tracking application that uses AI to identify food items from photos and estimate their calorie, protein, and carbohydrate content. The App also includes an AI Voice Assistant ("Aria") powered by Google Gemini Live API for real-time health conversations. Nutritional estimates and AI responses are approximate and for informational purposes only.

3. Medical Disclaimer

⚠️ HealthTrack PRO is NOT a medical device or medical service. HealthTrack PRO provides nutritional estimates and is not intended to diagnose, treat, cure, or prevent any disease. The AI Voice Assistant (Aria) provides general health and nutrition guidance only — it is not a substitute for professional medical advice. Do NOT use this App as a substitute for professional medical, dietary, or nutritional advice. Always consult a qualified healthcare provider before making significant dietary changes.

4. In-App Purchases & Token System

The App uses a coin/token system for AI features:

  • Every new account receives 10 welcome coins upon registration.
  • AI food scans (Paid mode) cost 1 coin per scan.
  • AI Voice Assistant (Aria) costs 1 coin per 5 minutes of active conversation. The session timer persists across app restarts — you are billed for the full 5-minute window even if you close and reopen the session within that window.
  • If your balance drops below 2 coins during a Voice Assistant session, Aria will give a farewell message and the session will close at the end of the current 5-minute window.
  • Token packs can be purchased via the HealthTrack website (healthtrack.proh.top/recharge) using Razorpay as the payment processor, or via Google Play Billing when available. When you tap a token pack in the app, you will be shown a choice of payment method.
  • Purchases made via the HealthTrack website are processed by Razorpay and are not managed by Google Play. Google Play's refund policies do not apply to Razorpay transactions. Razorpay's own Privacy Policy and terms apply.
  • Purchases made via Google Play are subject to Google Play's Terms of Service.
  • All token purchases are non-refundable except where required by applicable law. Tokens are consumable and do not expire.
  • Coin deductions for Voice Assistant sessions are final and non-refundable.

5. AI Voice Assistant (Aria)

  • Aria is an AI assistant powered by Google Gemini Live API. Responses are AI-generated and may be inaccurate.
  • Using Aria requires microphone permission. By granting microphone access, you consent to your voice being streamed to Google Gemini Live API for real-time processing.
  • We do not store raw audio. A text transcript is saved to your account for conversation memory.
  • Aria is available to signed-in users only. Guest users cannot access the Voice Assistant.
  • You must not use Aria to generate harmful, abusive, or illegal content.

6. Automatic Data Purging

To manage third-party storage costs and service quotas:

  • Meal photo images stored on Cloudinary are automatically deleted after 90 days from the date of upload. Your food log entries and nutritional data are not deleted — only the photo attachments are removed.
  • Food log entries stored in Firebase Firestore are automatically deleted after 630 days from the date of creation.
  • Voice assistant transcripts are retained until account deletion.
  • You may review your data at any time before the retention period expires.

7. User Responsibilities

  • You are responsible for the accuracy of any data you enter.
  • You must not use the App for any unlawful purpose.
  • You must not attempt to reverse-engineer, hack, or disrupt the App or its services.
  • You are responsible for maintaining the security of your Google account.
  • You must not use the AI Voice Assistant to generate harmful, abusive, or illegal content.

8. Intellectual Property

All content, design, and code in the App are owned by PROHOSTVPS.COM or its licensors. You may not copy, modify, or distribute any part of the App without written permission.

9. AI-Generated Content

Nutritional data and Voice Assistant responses are generated by AI models and are provided "as is" without warranty of accuracy. We are not liable for decisions made based on AI-generated nutritional estimates or AI assistant responses.

10. Limitation of Liability

To the maximum extent permitted by law, PROHOSTVPS.COM shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to health outcomes based on nutritional estimates or AI assistant advice.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time for violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which PROHOSTVPS.COM operates, without regard to conflict of law principles.

13. Changes to Terms

We may update these Terms at any time. Continued use of the App after changes constitutes acceptance.
